Membership Agreement
Bellevue Badminton Club, Inc. (BBC or the Club) and the person identified in the associated enrollment record (the Member) agree to the following membership terms. Membership dues and charges for individual bookings are separate purchases.
1. Membership Plans and Benefits
The Member purchases the plan identified in the associated enrollment record. That record forms part of this agreement and states the covered members, term dates, price, tax, other agreed charges, and acceptance date. This agreement may be signed on paper or electronically without entering those details again. BBC will provide a retainable copy of the accepted agreement, enrollment record, and applicable policies.
BBC provides membership access to its indoor badminton facilities, courts, nets, and the booking and activity privileges applicable to the selected plan. Current plan prices and benefit details are published at BellevueBadminton.com. Court rental, guest fees, equipment rentals, and paid programs are additional unless expressly included. Membership does not guarantee a particular court or preferred booking time.
Singles Membership covers one person of any age for one year. A junior member must have a parent or legal guardian with an account in the same CourtReserve family unit to sign on the junior member's behalf.
Doubles Membership covers any two people for one year. Family Membership covers up to two parents and three children from the same household for one year. A Family Membership also gives covered children under age 17 access to designated free-play periods at participating locations. The current times, eligibility details, and requirements are published at BellevueBadminton.com.
One Month Membership provides membership access for 30 calendar days. One Day Membership provides membership access for the remainder of the local calendar date on which payment is made and expires at midnight when that date ends. These are one-time purchases and do not automatically renew. Access remains subject to operating hours, booking requirements, and applicable plan restrictions.
The Member understands that payment methods and other account information associated with a shared Doubles or Family membership may be shared with and accessible to other people in the associated membership/family account. The payer authorizes charges made under this agreement and through authorized account use, not unrelated charges merely because account information is visible.
BBC's operator and legal-notice address is Bellevue Badminton Club, Inc., 13405 SE 30th St., Suite 1C, Bellevue, WA 98005. General account questions may be emailed to info@bellevuebadminton.com.
Membership Terms, Payment, and Renewal
2. Membership Terms, Renewal, and Reinstatement
Singles, Doubles, and Family memberships run for 12 months and automatically renew on their anniversary unless canceled before the renewal date. A valid payment method must remain on file for automatic renewal. BBC will email the primary account holder a renewal reminder 14 days before renewal. The renewal bill becomes available for payment during that window; creating the bill does not itself charge it.
The Member authorizes BBC and its payment processor to collect disclosed annual dues and tax at renewal and other separately authorized charges. Early payment reduces the renewal bill without duplicate collection. One Day and One Month purchases do not automatically renew.
If a membership payment fails, membership is automatically canceled and membership privileges cease. Successful payment to reinstate an annual membership begins a new 12-month term with a new anniversary. The term is not backdated to include the inactive period. Reinstatement does not automatically restore canceled reservations or erase valid outstanding charges for services already provided.
Membership belongs to the enrolled people and may not be transferred, lent, sold, or reassigned. A member cannot be swapped out for another person. The Member agrees to follow BBC's published process for any permitted plan change. A voluntary downgrade does not create a right to a prorated credit or refund, subject to mandatory legal rights.
When a Singles member upgrades to Doubles or Family within 90 days of paying for the Singles membership, the full amount actually paid for the Singles membership is deducted from the first year's bill for the new plan. The upgraded membership retains the original anniversary date; the upgrade does not start a new 12-month term. This upgrade credit is not a cash refund or a transferable credit. Memberships are not paused unless BBC expressly agrees in writing or applicable law requires another remedy.
3. Prices, Account Information, and Payment Responsibilities
The Member agrees to pay the membership dues and other charges accepted during enrollment or an authorized purchase. The most up-to-date prices are published at BellevueBadminton.com and reflected in the applicable purchase process. BBC may adjust prices and fees within the limits of applicable law, including any legally required limits on increases and disclosures. The renewal bill and notice identify the amount due for the upcoming annual term.
A price change does not, by itself, retroactively change an existing booking. If the Member updates or edits any part of a reservation after a price change, the reservation will be recalculated using the current price. The revised amount must be shown before the edit is completed; the Member agrees to pay the resulting authorized charges. BBC's reassignment of a court under Section 5 does not trigger this member-edit repricing rule.
The Member agrees to keep contact details, enrolled-member information, family-account links, and payment information accurate and current. The Member is responsible for monitoring their bookings, membership dates, payment obligations, account status, and reminder emails. Incorrect contact information or an overlooked reminder does not automatically create an exception to a valid payment or cancellation requirement.
The Member agrees to report incorrect or duplicate charges promptly; BBC will review the records and correct substantiated errors. Undisputed amounts remain payable and lawfully collectible. Lawful payment disputes do not themselves trigger penalties; this agreement authorizes neither undisclosed fees nor collection of unearned annual dues.
Court Reservations and Organized Play
4. Court Reservations and Payment
CourtReserve allows eligible members to reserve available courts for one to three hours in 30-minute increments, up to four weeks (28 days) in advance. Each court requires at least two and ordinarily no more than six players on the reservation. A seventh and eighth player may be added at check-in for an additional fee regardless of membership status; nonmember guest fees are additional where applicable.
Reservations depend on availability and the reservation type's rules. Payment by credit card on file is required within 15 minutes of booking or the reservation is automatically canceled. All players must be on the reservation, with charges paid before play. Types may differ in eligibility, benefits, and cancellation rights. Noncancelable or restricted terms must be disclosed before payment and supersede the ordinary customer-cancellation schedule, preserving BBC-cancellation remedies and mandatory rights.
The Sandwich Rule
The Member agrees not to book a reservation that leaves an isolated 30-minute gap on the same court between the reservation and another scheduled item, either before or after the reservation. This is the sandwich rule.
The sandwich rule is bypassed when a reservation is made with less than three hours remaining before its scheduled start. All other booking, payment, cancellation, and access rules remain in effect, but the booking may leave a 30-minute gap on the schedule. This is done to allow maximum efficiency of the courts so as many members can play badminton as possible.
5. Reservation Changes, Staff Assistance, and Discounts
Once a reservation is made, the Member may change the players on the reservation, subject to eligibility and payment requirements. The Member may not shift the reservation earlier or later or change its time, location, duration, or court number. Those changes require cancellation and rebooking, with availability, current pricing, and the applicable cancellation policy applying to each transaction. A replacement booking does not waive charges on the original reservation.
Staff may explain rules and provide authorized services, including changes to the players on the reservation, additional-player check-in, and eligible late organized-play registration. Staff cannot otherwise bypass member restrictions. BBC may reassign courts without notice only with time, location, and price unchanged; other changes require customer agreement or the BBC-cancellation remedy in Section 7.
The Member agrees that promo codes and promo-code discounts can be applied only during the initial payment of a reservation. They cannot be applied to reservation extensions or added after any full or partial payment has been made.
6. Organized Play and Programs
BBC organizes play through coordinated courts, partners, rotations, or ratings as applicable. Registration provides participation in that event, without unrestricted court use. The Member agrees to meet registration, payment, eligibility, check-in, equipment, shuttle, and score-reporting requirements and follow organizer instructions. Late registration requires BBC approval and confirmation of eligibility and payment.
Current organized-play and class schedules, policies, requirements, and program details are published at BellevueBadminton.com and supplied or identified with the applicable registration. Ordinary organized-play cancellations follow Section 7 unless a different reservation type's cancellation terms were clearly disclosed before payment.
Cancellations, Refunds, and Credits
7. Reservation and Organized-Play Cancellations
For cancelable reservations and organized play, the following terms apply to customer-initiated cancellations. Eligibility is measured from the scheduled local start time using the recorded cancellation or the time BBC receives the permitted request. Membership cancellation is addressed separately in Sections 13 and 14.
At Least 24 Hours Before the Start
The Member may cancel through CourtReserve and will receive full credit to their account balance. A refund to the original payment method is available only if BBC receives a written request at info@bellevuebadminton.com within 28 days of the cancellation request and the credit issued for that cancellation remains entirely unused. When an eligible original-payment refund is processed, the corresponding credit will be removed to prevent duplicate recovery. Mandatory legal refund rights are not restricted by these conditions.
Less Than 24 Hours Before the Start
The Member must contact the front desk at any BBC location before the booking begins to receive 50% credit to the CourtReserve account balance. This late-cancellation credit is not refundable to the original payment method, except where law requires otherwise.
Once the scheduled reservation or event start time has arrived, no refund or credit is available for customer cancellation or nonattendance. This does not remove the remedies below when BBC cancels or any mandatory legal rights.
When BBC Cancels
If BBC cancels a confirmed paid booking, or cannot provide it within Section 5's permitted court-reassignment limits, BBC will refund the full amount paid for that booking to the original payment method unless the customer prefers account credit. Customer late-cancellation charges do not apply. BBC is not responsible for finding or rebooking a replacement court and will not require the customer to accept another time or location instead of the applicable refund.
8. Credits, Refund Processing, and Exceptions
When the Member initiates an eligible customer cancellation/refund request under Section 7, the applicable credit will be given to the Member's CourtReserve account balance. Credit is the initial disposition for those requests; an original-payment refund requires Section 7's timely written request and unused-credit condition. BBC-caused cancellations and legally required refunds remain subject to their own remedies.
CourtReserve administers credits. Original-payment refunds generally take three to five business days to process, plus bank posting time. The Member agrees to report missing credits or refunds to info@bellevuebadminton.com. Processing estimates do not extend legal deadlines.
Account credit is available account value rather than a payment returned to a bank or payment card. It does not restore an inactive membership or override an activity's eligibility requirements. Any applicable credit restrictions must be disclosed, and BBC will not substitute credit for a legally required refund without a legally valid customer choice.
The Member agrees to plan responsibly for schedules, travel, finances, and weather. Difficulty reaching an operating club, inclement weather, or changed plans does not excuse cancellation charges. Extraordinary circumstances may be emailed to info@bellevuebadminton.com; BBC has no obligation to make discretionary exceptions. Mandatory rights remain unaffected.
Access, Conduct, and Court Use
9. Individual Check-In, Guest Access, and Early Access
Each person agrees to check in individually at the kiosk or with the front desk before playing. A member may not check in for another member, have another member check in for them, or use another person's credentials. Check-in is permitted no earlier than 15 minutes before the reservation, event, or class starts. Every player must be on the applicable reservation or registration. Where kiosk check-in is unsuccessful or credentials are inaccessible, the person must obtain front-desk assistance before entering to play.
Guests agree to complete required waivers, pay applicable guest and additional-player fees, and follow club policies. Public-portal bookings may have different disclosed restrictions. Spectators may remain in designated lobby and waiting areas but may not enter courts.
Early access is available only to eligible active members at participating locations during the published access periods. Access hours and arrangements, including those at Southcenter, may differ by location and change as provided in Section 12. Every person using early access must have applicable privileges and their own authorized credentials. The Member agrees not to share access credentials or admit nonmembers to play outside posted business hours.
BBC may use cameras and review early-access footage to verify access, investigate unauthorized entry or court use, and enforce club policies, subject to applicable law. This does not authorize recording in private areas or unlawful recording of conversations. Bringing a nonmember to play outside posted business hours carries the published $100-per-offense charge and a formal warning; repeated violations may lead to loss of privileges or exclusion, subject to Section 13 and applicable law.
10. Conduct, Footwear, Court Time, and Facility Care
The Member agrees to treat players, visitors, staff, coaches, and volunteers respectfully and to follow lawful staff directions and posted club rules. Harassment, intimidation, abusive language, illegal activity, tobacco products, illegal substances, and alcohol are prohibited. Athletic attire must be appropriate for a family environment. Indoor-specific, non-marking shoes not worn outdoors are required; approved rental shoes are subject to the disclosed charge, fit, and availability.
By booking a court, the Member agrees to use the assigned court for the reserved time and not play beyond the reservation's end. After individual check-in, members may begin warming up up to 15 minutes early only on their assigned court if it is empty. This limited warmup permission does not allow use of any other empty court, extend the reservation, or displace the preceding reservation. Additional play time must be booked and paid for before play continues.
Except for that limited authorized warmup, no unreserved or unauthorized court use is permitted. An empty court, lack of staff intervention, or willingness to pay afterward does not create permission. BBC may charge for proven unauthorized use at the applicable standard court rate, with a minimum charge equivalent to 30 minutes plus unpaid guest fees. This is a billing minimum, not a grace period or permission to play. BBC will identify the charge's basis and review reported errors.
The Member agrees to keep equipment and belongings clear of courts and walkways, wait for rallies to finish before crossing or approaching courts, and report hazards promptly. No food or gum is allowed in the gym; only water in closed, spill-proof containers is permitted. Reasonable supported cleaning or repair charges may apply to damage caused by a failure to follow club rules, without duplicate recovery.
Commercial Activity, Notices, and Disruptions
11. Coaching, Commercial Activity, and Third Parties
Coaching, training others, and conducting business at BBC require prior written management permission. Members in the same family unit may coach one another and conduct organized drills if they are on the same membership or documented in the same family unit in CourtReserve. This exception does not authorize commercial coaching of others.
The Member agrees not to resell court time, add a markup, or collect reimbursements that in total exceed the original court cost paid. Violations may result in loss of booking privileges. Membership or a court booking does not independently authorize commercial activity.
BBC may allow independent third parties to conduct business or offer products and services at the club. Unless BBC expressly states otherwise, those parties do not represent BBC and are responsible for their own conduct and offerings. BBC does not endorse or guarantee those offerings and is not responsible for claims arising from them to the extent permitted by law. The Member agrees to identify the provider and applicable purchase terms when dealing with an independent provider. This provision does not disclaim BBC's own obligations or responsibility that cannot lawfully be excluded.
12. Notices, Policy Changes, and Disruptions
BBC sends booking confirmations and cancellations to the account email, with app notifications where available. Renewal notices go to the primary account holder as described in Section 2. The Member agrees to maintain current contact information and remain attentive to account status and reminders. Nonreceipt of a message does not automatically settle a dispute; BBC will review the relevant transaction and notice records.
If a genuine CourtReserve failure prevents an otherwise permitted action, the Member agrees to contact the front desk or info@bellevuebadminton.com promptly, before the deadline where possible, identify the booking and requested action, and preserve available evidence. BBC will use the documented time of a substantiated request to assess eligibility rather than a later processing time. An unsupported report or a properly blocked action does not establish entitlement to an exception.
BBC will provide advance notice of scheduled disruptions and block courts where appropriate. Unscheduled disruptions such as power outages, emergencies, or weather events may occur without notice. If BBC cancels or cannot supply a confirmed booking, Section 7 applies. A member's inability to reach an otherwise operating club is governed by Section 8.
Operational hours and access arrangements are subject to change. BBC will provide advance notice of planned material changes to paid benefits where practicable; emergency restrictions may take effect immediately. Website or policy changes do not erase accrued refund rights or mandatory protections. Reservation repricing following member edits is governed by Section 3.
Membership Cancellation and Required Protections
13. Membership Cancellation, Suspension, and Termination
The Member may cancel ordinary automatic renewal through CourtReserve or by emailing info@bellevuebadminton.com from their account email. The request must be made before the renewal date to prevent renewal. A cancellation on or after the renewal date does not qualify for a refund of that renewed term merely because the Member intended not to renew or overlooked the reminder, except where Section 14 or applicable law requires a refund. The Member is responsible for tracking renewal dates, finances, and reminder emails. Ordinary cancellation ends future renewal while access continues through the paid term.
BBC will confirm the cancellation's effective date; the Member agrees to keep the confirmation and contact BBC if it does not arrive. The statutory cooling-off notice below preserves the delivery/mail method required for that protected right; it does not replace CourtReserve and email as BBC's ordinary cancellation channels.
BBC may restrict booking, suspend access, or terminate membership for nonpayment, fraud, credential misuse, unauthorized business, resale, unsafe conduct, or other material policy violations. Where practicable, BBC will identify the reason and permit a response or correction; serious safety or security concerns may require immediate action. The Member may request review at info@bellevuebadminton.com. Enforcement does not automatically forfeit every prepaid amount; BBC will account for valid charges and refunds required by law.
BUYER'S RIGHT TO CANCEL
You may cancel this contract without penalty by delivering or mailing written notice that you do not wish to be bound before midnight of the third business day after signing. Mail or deliver notice to Bellevue Badminton Club, Inc., 13405 SE 30th St., Suite 1C, Bellevue, WA 98005. A business day excludes Sundays and legal holidays. BBC also accepts CourtReserve or email notice within that period. If you cancel within the three days, BBC will return all amounts paid under this membership contract within 30 days.
14. Required Cancellation and Refund Protections
Where Washington's Health Studio Services Act applies, the Member retains its protected cancellation rights, including death or total disability, permanent closure without comparable BBC facilities within ten miles, failure to complete a promised facility/improvement on time, and qualifying preopening cancellation within the first five business days of operation. Disability confirmation may be required from a physician agreeable to both parties.
For contracts extending beyond one year, the Act also provides cancellation on 30 days' written notice and qualifying relocation rights after one year: permanent relocation more than 25 miles from BBC or an affiliated comparable facility without added expense, subject to the additional-five-mile condition if already living more than 25 miles away at signing. These rights depend on their statutory conditions, not the contract's label.
For a protected cancellation, BBC will refund unused prepaid dues, end future dues for the canceled period, and provide other required refunds within 30 days after receiving written notice, using any legally required proration. Any separately disclosed one-time joining fee receives its required legal treatment. Mandatory refunds are not replaced with account credit without a legally valid customer choice. These protections control over conflicting terms; see RCW 19.142.040 and 19.142.050.
Disputes and Safety
15. Dispute Resolution
The Member agrees to report a concern to info@bellevuebadminton.com with the account, transaction, requested remedy, and supporting records. BBC will investigate and explain its decision. Seeking informal resolution is encouraged but is not a condition that forfeits a legal deadline, payment-dispute right, regulator complaint, or small-claims remedy.
BINDING ARBITRATION AND SMALL CLAIMS
Except for eligible small-claims cases and claims that law does not permit to be arbitrated, BBC and the member mutually agree to individual disputes under this agreement being resolved by binding JAMS arbitration rather than a court trial, including a jury trial. This clause does not create a separate class-action waiver. JAMS Consumer Minimum Standards and applicable consumer procedures govern; statutory remedies and reasonable information exchange remain available. Both parties participate in selecting a neutral arbitrator.
Either party may use small-claims court for eligible claims. Arbitration location or remote participation must not prevent consumer access; an East King County venue is used only if accessible and consistent with governing requirements. Consumer arbitration fees are limited by JAMS standards and applicable law; BBC pays arbitration costs allocated to it under those standards. Attorney fees are awarded only as authorized by applicable law or a valid governing provision, without overriding consumer protections. If JAMS declines administration because this clause fails its consumer standards, BBC will not rely on that failure to block an otherwise available court remedy.
16. Safety and Personal Property
The Member understands that badminton involves physical risks and agrees to use appropriate equipment, follow safety instructions, and take reasonable precautions. BBC is not an insurer of personal belongings. Any separate activity waiver applies only to the extent legally enforceable; this agreement does not release liability or waive remedies that cannot lawfully be waived.
Media Consent and Acceptance
17. Media Release
I consent to photographs and videos lawfully taken of me inside BBC by BBC, its authorized representatives, or other members being reproduced, edited, published, displayed, distributed, and shared online, on social media, and in printed or digital marketing and promotional materials. I grant BBC and those members nonexclusive, worldwide permission to use my image and likeness for these purposes without compensation or further approval. Authorized materials may remain in use after my membership ends.
To the extent permitted by law, I release BBC and the members using the images from claims based solely on uses authorized by this release. This does not authorize unlawful recording, harassment, defamatory or misleading use, recording in restrooms or changing areas, or recording private conversations without required consent. It does not transfer another person's copyright or waive rights that cannot lawfully be waived. A person supplying an image must have the necessary rights to permit its use.
I give consent for myself and, only where I have legal authority and sign in that capacity, for covered minors identified in my membership record. This release does not supply consent for another adult. Members taking or sharing images must follow club rules and respect the rights and required consents of everyone depicted.
18. Agreement and Acknowledgment
Mandatory law controls. This agreement and the completed enrollment record govern membership; the dated booking, cancellation, guest, early-access, footwear, organized-play, conduct, and coaching policies supplied with enrollment govern their stated subjects consistently with this agreement. Separate class and private-event contracts remain separate. BBC must provide the accepted agreement, plan description, and applicable rules when you sign; a general website link alone does not replace delivery. Lawful prospective updates follow Section 12. An invalid provision does not waive statutory rights or limit any consequence required by law.
By signing this agreement, I acknowledge that I have been provided and can retain the associated enrollment record, this agreement, the plan description, and the identified policy copies. I understand annual renewal, payment authorization, booking limits, cancellation/refund rights, the media release, and the arbitration clause. I accept for myself and, where legally authorized and identified in the membership record, in my capacity as guardian of covered minors; I do not sign away another adult's rights. BBC retains my signed agreement, acceptance date, applicable version, and associated enrollment and policy records, whether acceptance is on paper or electronic.
